CAN-SPAM Act is a law set for sending the commercial electronic mails by the President of United States in 2003 to give the recipients right to stop the sender from sending junk e-mail. The Federal Trade Commission (FTC) enforce this law for the citizens of America. It applies on bulk emailing as well as on all the commercial mails.
So, how one can recognize a mail as commercial email?
“A commercial mail is an electronic mail which is sent for the purpose of commercializing, advertising or for publicity of a product.”
“Violation of CAN-SPAM Act cause penalties such as probation, house arrest and fines.”
But CAN-SPAM Act is not so much complicated to follow, it just requires some points to remember while emailing such as follows:
1. Don’t use misleading headers
Headers such as “TO:”, “FROM:” , your domain name and all contacting information must be true.
2. Never use misleading Subject line
Your subject line should be accurate and to the point. You cannot use subject as “You have left your key”, this is wrong.
3. Mention your physical address
Always tell your recipient about your location by writing your valid postal physical address in your email.
4. Unsubscribe option
Give your recipients the choice of not getting emails from you in near future by providing a unsubscribe button. The recipients have the right to opt out from your emails anytime.
5. Honour recipients choice
When a recipient opt-out from your subscription or do not want any more mails from you in future, then you should respect his choice and this should be done within 10 days of request.
6. Always monitor your work
It is always the duty of the owner to monitor the work going on his behalf in the company. It is legally the user responsibility to take the charge of any email marketing actions done on his behalf.
7. Tell if it’s a ad:
Tag your email with ad tag if its a advertisement. It is the right of the recipient to know about the emails he is receiving.
